1. GENERAL PROVISIONS

The website www.cushy-design.com is owned by M Design (hereinafter referred to as M Design). M Design makes it possible to use the services and content of the website www.cushy-design.com which is governed by these Terms of Use. The terms of use prescribe the rules for end users and refer to the use of the website www.cushy-design.com. By using the website, end users declare that they agree with the General Terms and Conditions of Business and Use and agree to use the www.cushy-design.com website in accordance with them. Access to www.cushy-design.com websites may sometimes be unavailable due to work, maintenance or the introduction of new content and in cases of unforeseen circumstances beyond the company's control. M Design, which we will try to remove as soon as possible. All materials found on the www.cushy-design.com website are the exclusive intellectual property of M Design and may only be used with the express permission of the copyright holder and trademark and/or design rights holder. The user can send his inquiries and comments in writing, by mail or e-mail, and M Design will send a written answer by mail or e-mail within the legal deadline.


 

2. BASIC TERMS

In terms of these terms of sale, the customer is a natural or legal person who orders at least one product, fills in the required information and pays for the ordered product through the www.cushy-design.com website. If information about a legal entity is entered in the buyer's data, then the buyer is considered a legal entity, and the natural person whose data is entered is considered the authorized person of the buyer.


 

3. PERSONAL INFORMATION AND BUSINESS CAPACITY

For a valid product order, the person completing the order must be over 18 years of age (business capacity). The customer is responsible for the accuracy and completeness of the data entered during registration. M Design reserves the right to change these conditions of sale and may change them without prior notice, but undertakes to inform all registered users via the e-mail addresses they entered during registration. Any possible changes will be applied to the use of the www.cushy-design.com site.


 

4. PRICE

M Design undertakes to clearly, visibly and legibly highlight the amount of the retail price in accordance with Article 7 of the Consumer Protection Act (Official Gazette 41/14). M Design will periodically, in accordance with its decision, put certain products on special sale at a price that is lower than the price of those products in regular sale, and also undertakes to clearly and legibly mark and indicate the duration of the special sale. After the expiration of the promotional sale period, M Design will not accept orders under the terms and conditions of the expired promotional sale.


 

5. PRODUCT DATA AND PRODUCT AVAILABILITY

Product information on www.cushy-design.com is edited based on the M Design database. Product photos are illustrative in nature and do not always have to correspond in all details to the products that are the subject of the order. M Design especially points out that the visual identity of the product shown in the photo does not have to correspond to the appearance of the product in reality, especially considering the monitor settings on the customer's computer, differences in the perception of colors as the customer sees them on the screen, etc. In the case of the above discrepancy between the product shown in the photo and the delivered product, it is not a product defect. Product information (product description, price, etc.) displayed on www.cushy-design.com is subject to bugs, application malfunctions, other technical irregularities, typographical errors, etc. In the event of obvious errors or inaccuracies in product information displayed on the web, M Design reserves the right to unilaterally terminate the contract. The subject of the order can only be products that are indicated in the order as being available in the warehouse and products that are not available in the warehouse, but can be delivered within 25 working days, not including Saturday. Due to the large number of orders placed simultaneously on www.cushy-design.com, it may happen that the product availability information is not the same as the state in the M Design warehouse. If the ordered product is not available in the warehouse, M Design will inform the customer that the product is currently not available, the deadline in which the product is available, and at the same time offer the possibility of purchasing an alternative product from www.cushy-design.com that is available for delivery and which is characteristics closest to the product that cannot be delivered.


 

6. ORDER AND MOMENT OF CONTRACT CONCLUSION

Products are ordered by selecting, using the menu and filling out the electronic form. The customer can order and purchase the product as a registered or unregistered user. The product is considered ordered when the customer goes through the entire ordering process.

Payment for ordered products can be made in the following ways:

  • E-banking

  • Burmese payment

  • Card payment

The order is considered received:

  • In case of payment by e-banking or general money order - at the moment when www.cushy-design.com receives the order electronically

  • At the moment when the order is received, M Design will notify the customer via electronic means in the form of e-mail that the order has been received or that the product has been successfully ordered.

If the customer does not receive the notification from the previous paragraph, it is suggested to check:

  • Is the message in the Junk/Spam folder?

  • Is the mailbox full?

  • Are the items in the cart after logging in to www.cushy-design.com, and if they are not, the customer should repeat the ordering process

  • After the product has been packed in the warehouse, M Design will notify the customer electronically in the form of an e-mail that the product has been purchased and that the product has been shipped.

In the case of payment by e-banking and general money order, the contract is considered concluded at the moment M Design receives confirmation that the order amount has been paid.

If the product is ordered, and e-banking or general payment is chosen as the payment method, M Design undertakes to reserve the product in the warehouse for 3 working days, not including Saturday. After the expiration of 3 working days from the receipt of the order, M Design does not guarantee the availability of the product.
 

7. METHOD OF PURCHASE ON THE WEB SHOP

By selecting each product, details are printed next to it - product name, short description, price, quantity and whether it is available in stock.

  • By selecting an individual product, it is added to your shopping cart.

  • The prices displayed on the pages next to individual products are valid for all forms of payment.

  • By accessing the "basket", the customer gets an overview of the selected products, their quantity and price.

  • The product included in the "basket" is purchased by clicking the "Checkout" button.

  • After pressing the "Checkout" button, the customer accesses the order form in which you must enter personal data. If the buyer's personal data differs from the recipient's personal data, you are obliged to correctly indicate the recipient's data by selecting the specified option.

  • When ordering, the postage price will be indicated next to each product.

Postage is shown separately and is not included in the price.

After receiving the data from the order, a notification will be displayed on the screen that the customer's order has been received, and the customer will receive a special notification about the receipt of the order electronically to the specified e-mail address. If payment by e-banking or general payment order is selected as the form of payment, and www.cushy-design.com does not have the ordered product, the customer will be informed of this within a reasonable period of time and M Design will refund the money paid. In the case of the above-mentioned payment, the customer is responsible and bears the risk for the accuracy and truthfulness of the data provided, given that M Design will refund the funds in accordance with the data provided.

 

8. CHARGE / AUTHORIZATION

All prices are expressed in euros (€).
In case of payment by e-banking or general money order, payment costs and/or interbank transactions are not included in the price.
 

9. USE OF COUPONS AND DISCOUNTS

To our Facebook friends (fb page Cushy Design) and recipients of e-mail notifications about actions (newsletter), we occasionally give coupons for special promotions, benefits and discounts. If you are not yet receiving our newsletter, do not miss the opportunity and sign up here.
 

10. DELIVERY

Products can be ordered for delivery in the territory of the Republic of Croatia and all other member states of the European Union, according to the conditions that apply to each delivery area.Delivery in the territory of the European Union is carried out via the delivery service chosen by M Design.

  • Product packaging is included in the delivery price.

  • Delivery is not included in the price of the product.

M Design undertakes to deliver the ordered product no later than within 25 working days from the date of conclusion of the contract, i.e. the day when the payment was made for the ordered product.Delivery is carried out in accordance with the terms of use of the delivery service, and is considered completed at the moment of handing over the product to the delivery service.

If the product sent to the customer or recipient is returned to M Design because the delivery service failed to deliver, the customer will be notified by e-mail and will be offered the following options:

That the ordered product, at the customer's request by e-mail, be re-delivered to the customer's or recipient's address.

If the buyer does not respond to the e-mail sent to him within 3 days and chooses one of the offered options, the selected product will be sent to the buyer's address by delivery service.

When M Design delivers the product to the customer or recipient via the delivery service, the customer or recipient is obliged to take delivery by signing the delivery note, which confirms that the product has been properly delivered.

11. MATERIAL DEFECTS OF THE PRODUCT

M Design is responsible for material defects of items it sells on its website in accordance with the positive regulations of the Republic of Croatia, especially the Law on Obligations.

The ordered products are packed in such a way that they are not damaged by normal handling during transport/delivery. In the event that the shipment is damaged during transport, such damage is visible when the shipment is picked up, and in that case we suggest that the buyer does not pick up the shipment. We ask customers to contact us so that we can check the status of the shipment as soon as possible and send a new one.

In the case of a visible lack of product when taking over the shipment, the buyer is not obliged to take over the delivered product, can refuse receipt, and does not bear the costs of delivering such a product. It is considered that the products that were properly received by the customer had no visible defect.

When receiving the goods, checking the correctness of the order depends on the buyer, and the buyer is obliged to compare the received items with the invoice, if something is missing, he is obliged to send a written complaint to design@kljucinterijeri.com within fourteen days, as subsequent complaints will not be accepted.

By refusing receipt, the delivery service will return the shipment to M Design, noting that the shipment contains a defect. If the product has a hidden defect (a defect that could not be detected by a normal inspection when picking up the item) that the customer finds after opening the product - the customer has the right to unilateral termination of the contract and refund, replacement of the product, removal of the defect or price reduction.

12. WRITTEN COMPLAINTS, REFUNDS, EXCHANGE

If the customer is dissatisfied for any reason, he can send a complaint by e-mail to: design@kljucinterijeri.com

The customer has the right to a justified complaint and to return the goods in the following cases:

  • Delivery of goods that were not ordered

  • Delivery of goods that have a fault or damage that did not occur during transport

In the case of a request for the return of goods for justified reasons, the customer is obliged to send a written complaint via e-mail design@kljucinterijeri.com

In order to determine as quickly as possible the specific order to which the customer has a complaint, customers are asked to state the order number, account number or their username in the complaint. M Design will confirm the receipt of the complaint in writing without delay, and the response according to Article 10.para.5. of the Law on Consumer Protection must arrive within 15 (fifteen) days from the day the complaint was received.

In the event of a justified complaint, the customer has the right to terminate the contract with a refund of the amount paid or exchange for a correct, undamaged and valid product.

M Design will accept the return of damaged, defective or wrongly delivered goods at its own expense, if it is determined that the complaint is justified and that the customer has not affected the correctness, damage or any defect of the goods.

In the event of a justified complaint, the cost of replacing the product with a new product is fully borne by M Design.
 

13. RIGHT TO UNILATERAL TERMINATION OF THE CONTRACT

The customer can unilaterally terminate within 14 days without giving a reason.

The customer does not have the right to unilaterally terminate the contract:

  • if the subject of the contract is sealed goods that are not suitable for return due to health or hygiene reasons, if they were unsealed after delivery,

  • if the subject of the contract is goods which, due to their nature, are inseparably mixed with other things after delivery,

  • if the subject of the contract is perishable goods or goods that quickly expire.

In order for the buyer to be able to exercise the right to unilaterally terminate this contract, he must notify of his decision to unilaterally terminate the contract before the expiration of the term, by means of an unambiguous statement sent by mail or electronic mail, in which he will state his name and surname, address, telephone number or address electronic mail.

We will send you the confirmation of receipt of the notice of unilateral termination of the contract by e-mail without delay.

The term for unilateral termination of the contract of 14 days starts from the day when the goods that are the subject of the contract are handed over to the buyer or a third person designated by the buyer, who is not the carrier.

If the customer unilaterally terminates this contract, M Design undertakes to return the money received, including delivery costs, without delay, and no later than within 14 days from the day when the M Design goods are returned or after proof that the goods are sent back.

The refund will be made in the same way as the payment was made. In the event that the customer agrees to another way of returning the paid amount, he does not bear any costs for the return.

The buyer is obliged to hand over or send the goods (to the address where they will be sent) without undue delay, and in any case no later than within 14 days from the day when the buyer sent his decision on unilateral termination of the contract. The direct costs of returning the goods are borne by the buyer.

The buyer is responsible for any decrease in the value of the goods that is the result of handling the goods, except for that which was necessary to determine the nature, characteristics and functionality of the goods.
 

14. APPLICATION OF TERMS OF SALE

By using the services of the cushy-design.com web shop, you accept these Terms of Sale.
If you do not agree to the terms, do not use these sites or order products through them.
M Design is not responsible for any damage caused by the use of this website and the use of information from this website for purposes that go beyond the scope of their intended purpose.
 

15. FINAL PROVISIONS

By accepting these conditions of sale, the buyer agrees to the provisions of these conditions and accepts that they form an integral part of the contract.

Payment methods:

BY BURMESE PAYMENT, E-BANKING, CASH ON DELIVERY or CARD PAYMENT

Upon completion of the order with the selection of Virman payment, we will send you a proforma invoice and payment instructions by e-mail. You can pay the bill at a bank or post office counter, or via internet banking. We pack and send the goods only after receiving the payment in the period indicated for each individual product. In the event that we do not receive your payment within the next 3 working days, we will consider that you have canceled the order.
